New Arizona Disclosure Reports Reduce Seller Liability

Under a new Arizona law effective September 21st, sellers and listing agents can greatly reduce their liability for disclosures by obtaining a “disclosure report” prepared by a third-party provider. To qualify, the disclosure report must must be based on officially adopted governmental maps, and must include disclosures on the following 9 conditions:

1. Special Flood Hazard Areas
2. Military Airports or Ancillary Military Facilities
3. Military Training Routes
4. Public or Private Airports
5. Expansive Soils
6. Soils Subject to Fissures
7. Special Tax Assessment Areas
8. Radon Gas Potential Zones
9. Environmental Hazard Superfund Sites

While it is not mandatory, it is recommended that sellers provide these reports to their buyers. However, disclosure reports are also available to buyers if the seller or builder does not provide one. I highly recommend making the investment, whether you’re the Seller or the Buyer. It’s under $100 and your Realtor can direct you to a third-party source or arrange to have one ordered on your behalf.

    New Grayhawk Community Park in Scottsdale, Arizona

    The City of Scottsdale is in the process of designing recreational amenities for Phase I of the new Grayhawk Community Park to be located on the southwest corner of Hayden Road and Thompson Peak Parkway adjacent to the Thunderbird Branch of the Boys and Girls Club. Preliminary plans include lighted ball fields, a lighted off-leash dog area, lighted multi-use courts and a playground.

    Please join the design consultants and City staff at a public meeting to review preliminary plans for the new facility and let us know what you think. The public meeting will be held on Tuesday, September 19 at 6:30 p.m .at the Thunderbirds Branch of the Boys and Girls Club, 20199 N. 78th Place.

    Grayhawk Community Park is funded by Bond 2000 and construction is expected to begin in 2007.

    North Valley Plans on Carefree Highway

    Partial Cloverleaf at I-17/Carefree Highway

    State transportation officials say a partial cloverleaf at the interchange is expected to accommodate traffic volume over the next 20-30 years. The $17 million Arizona Department of Transportation project is expected to break ground in the summer of 2007 and be completed by the end of 2008.

    Traffic is projected to increase from 9,600 vehicles per day in 2006 to 12,000 vehicles in 2016. Ever feel like your at the end of this line of traffic?? It’s about time - now what about widening I-17, which should’ve been done YESTERDAY.

    New, Creative Features for Luxury Homes

    Fancy master bedrooms, complete with a bedroom kitchen and sitting room, is a popular home amenity with today’s affluent home buyers, according to a report in the current issue of Unique Homes magazine. The publication lists 35 of the most sought-after amenities in today’s luxury homes. Decorative glass tiles are in, as are special features made from unique and exotic woods, it was noted. And, of course, a private spa has almost become a basic feature in upper-end homes. Showers must have all the bells and whistles, including multiple sprays and shower heads and even waterfall fixtures that mimic rainfall.

    Upscale kitchens often include a butler’s pantry, along with state-of-the-art upgrades in standard features such as a drawer refrigerator and drawer dishwasher. High-tech home offices are also becoming a standard feature. In fact, some new homes now feature dual “his and her” home offices. Exercise rooms and special “meditation spaces” are included in many of today’s luxury homes. Home theaters are becoming more popular and common. Smart-house technologies are an integral part of many new homes. Garages have undergone some of the most dramatic changes. They’ve become huge, accommodating many vehicles (or a lot of toys). They now include cabinet systems, artistic flooring and even appliances.

    Outside, in addition to lush landscaping some homes include putting greens or a private golf course. Some have a stocked fishing pond, while a waterfront home may have its own deep-water dock. The objective of all these luxury features is to enhance the owner’s living experience and enrich their lives. That works well for those who can afford it. For the rest of us, there are other ways to enrich our lives.
